Partner Referral Programme Terms & Conditions

Please read these Terms and Conditions carefully before you participate in the Partner Referral Programme as these will apply. We recommend that you print a copy of these Terms and Conditions for future reference. If you do not agree with these Terms and Conditions, you must not participate in the Partner Referral Programme. 

Please note that our Partner Terms of Business as set out at https://www.treatwell.co.uk/info/supplier-terms-and-conditions/ (the “Partner Terms of Business”) will continue to apply to your relationship with Treatwell and your use of https://www.treatwell.co.uk/ (the “Website”) and all Treatwell Services. 

Capitalised terms not otherwise defined in these Terms & Conditions shall have the meaning given to them in the Partner Terms of Business. 

1. Introduction to the Treatwell Partner Referral Programme

1.1 The Treatwell Partner Referral Programme (the “Programme”) gives Treatwell Partners (“Existing Partners”) the opportunity to receive either a Treatwell Gift Card (as defined below) or Monthly Fees Discount (as defined below) by referring a new salon (the “Referred Salon”) to Treatwell (the “Referral”). 

1.2 Once the Referred Salon is Live (as defined below), the Existing Partner will receive either a £100 Gift Card to be used as a customer on the Treatwell Website or App (the “Treatwell Gift Card”) or a discount of the monthly fee for the Treatwell Services for up to 3 months, depending on your price package as set out below (the “Monthly Fee Discount”). 

1.3 Please note that in order for the Existing Partner to be eligible to receive either the Partner Treatwell Gift Card or the Monthly Fee Discount, all of these Terms & Conditions must be satisfied. 

2. Eligibility of the Existing Partner and Referred Salon

2.1 In order to be eligible to participate in the Programme, the Existing Partner must have Partner Services available to purchase on the Website and the Booking App, and therefore be Live”, at the time the Referral is made. 

2.2 In order to be an eligible Referred Salon, the Referred Salon must: 

2.2.1 not have previously been a Partner who was terminated by Treatwell for a breach of the Partner Terms of Business or otherwise deemed by Treatwell in its sole discretion as illegible; and

2.2.2 offer 10 of any hair, nails, waxing, face treatments or massage treatments (“Key Treatment Types”), or a combination of some or all of the Key Treatment Types, as their main source of business, except in the case that Treatwell uses its discretion to allow for less than 10 Key Treatment Types as it may do so, by way of example only, for barbers or brow/lash bars. Whether the Referred Salon is offering Key Treatment Types as its main source of business shall be determined at the sole discretion of Treatwell. 

2.2.3 be either located in a retail premises or be home based providing the room in which Partner Services are provided is separate to the residential space in the premises, and not mobile; and

2.2.4 provide its services on and be able to offer at a minimum 2 full days availability.

2.3 There is no limit on the number of Referred Salons an Existing Partner can refer.

3. Instructions for Referral and duty to inform the Referred Salon

3.1 The Existing Partner must complete all details on the online referral form in order for a Referral to be made. 

3.2 The Existing Partner must tell the Referred Salon that:

3.2.1 it is referring the Referred Salon to Treatwell; and

3.2.2 it is eligible to receive either a Treatwell Gift Card or Monthly Fees Discount if the Referred Salon chooses to go Live.

3.3 If the Existing Partner does not inform the Referred Salon of the Referral as set out in clause 3.2 above, the Existing Partner will be in breach of these Terms & Conditions and this may result in a forfeiture of the Treatwell Gift Card or Monthly Fees Discount which would otherwise have been payable.

4. Treatwell Gift Card and Monthly Fees Discount

4.1 Each Existing Partner will only receive either the Treatwell Gift Card or Monthly Fees Discount once per Referred Salon

4.2 Where the Referred Salon is referred by more than one business, the Treatwell Gift Card or Monthly Fees Discount will only be issued once and to the Existing Partner who referred the Referred Salon first. 

4.3 The Referred Salon must be Live within one month from the Referral in order for the Existing Partner to be eligible to receive the Treatwell Gift Card or Monthly Fees Discount. 

4.4 The Existing Partner must be Live in order to be eligible to receive the Treatwell Gift Card or Monthly Fees Discount. If the Existing Partner is no longer Live between the Referral and the Referred Salon becoming Live, the Existing Partner will not be eligible to receive the Treatwell Gift Card or Monthly Fees Discount. 

4.5 The Treatwell Gift Card will be issued to the Existing Partner via email within a reasonable time after the Referred Salon has become Live. All terms relating to the Treatwell Gift Card, including the duration of the Treatwell Gift Card, are as set out in the Customer Booking Terms found here: https://www.treatwell.co.uk/info/booking-terms-and-conditions/

4.6 The Monthly Fees Discount will appear on the Existing Partner’s Invoice Statements after the Referred Salon has become Live and shall be set-off against the monthly subscription fee payable by the Existing Partner to Treatwell, in accordance with clause 10 of the Partner Terms of Business. For the avoidance of doubt, for the months in which the Existing Partner is eligible to receive the Monthly Fees Discount, the balance payable on the Invoice Statement for the monthly fee shall therefore be £0. 

4.7 The of number of months in which the Existing Partner will be eligible to receive the Monthly Fees Discount shall be, providing the Referred Salon and Existing Partner both stay Live for the duration of these periods:

4.7.1 For Existing Partners on the Plus pricing plan as set out in the Cooperation Agreement, 3 months; or

4.7.2 For Existing Partners on the Premium pricing plan as set out in the Cooperation Agreement, 2 months. 

4.8 If a Referred Salon ceases to be Live on the Website and/or Booking App for any reason during the period in which an Existing Partner is receiving or is due to receive the Monthly Fees Discount, the Existing Partner’s right to receive the Monthly Fees Discount shall end. For the avoidance of doubt, if, by way of example only, an Existing Partner on the Entry pricing plan makes a Referral and the Referred Salon only stays Live for 3 months, the Existing Partner will only receive the Monthly Fees Discount for those 3 months. 

4.9 If an Existing Partner ceases to be Live on the Website and/or Booking App for any reason during the period in which it would otherwise be eligible to receive the Monthly Fees Discount, the Existing Partner’s right to receive the Monthly Fees Discount shall end and the Existing Partner shall have no right to claim any other compensatory or monetary value for this period had it remained Live. 

4.10 There is no cash alternative to either the Treatwell Gift Card or Monthly Fees Discount.

5. Use of Personal Information

5.1 Participation in the Programme will require you to submit personal information about you and the Referred Salon, such as its name, contact telephone number and email address. However, you should only submit personal information about the Referred Salon after obtaining their express consent for you to do so. The personal information will be collected, processed and used by Treatwell as data controller in accordance with Treatwell’s Privacy & Cookie Policy which can be found here: https://www.treatwell.co.uk/info/privacy-policy/. You agree to receive communications from us with regard to your participation in the Programme and acknowledge and agree that we will communicate with any Referred Salon referred by you and will identify you as the Existing Partner who has made the Referral. 

6. Our right to vary the Programme 

6.1 We reserve the right to refuse to issue or void the Treatwell Gift Card or Monthly Fees Discount, terminate your eligibility to earn either or both the Treatwell Gift Card and Monthly Fees Discount, terminate your Partner account or terminate the account of the Referred Salon where we reasonably suspect any illegal or fraudulent activity by you and/or your Referred Salon or where you and/or the Referred Salon have violated these Terms & Conditions or any other of Treatwell’s Terms & Policies as set out here: https://www.treatwell.co.uk/info/terms-of-use/

6.2 We reserve the right to withdraw, change or substitute the Programme at any time, without notice and at our sole discretion.

6.3 In the event that the Programme is terminated, Treatwell will honour all Treatwell Gift Cards and Monthly Fees Discount earned or offered prior to its termination. It will, however, not be possible to earn further Treatwell Gift Cards or Monthly Fees Discount following termination of the Programme.

7. Liability

7.1 By participating in the Programme, you agree that you participate at your own risk. Except that Treatwell does not exclude or limit its liability for personal injury or death caused by its negligence or for fraudulent misrepresentation or any other liability that may not, by law, be limited or excluded, Treatwell accepts no liability in relation to an Existing Partner’s participation (or inability to participate) in the Programme to the maximum extent permitted by law, including any direct, indirect, incidental, consequential, or any other type of damages related to or arising from the Programme or your participation in the Programme.

8. General 

8.1 Every time you participate in the Programme, these Terms and Conditions as in force at that time (and available to view on the website) will apply. You can find the date on which these Terms and Conditions were last updated at the top of this page. You will be deemed to have accepted the Terms & Conditions in force at the time you participate in the Programme by virtue of your participation. 

8.2 If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall be unaffected and shall remain in force.

8.3 The Programme and these Terms & Conditions will be governed by and construed in accordance with the laws of England and Wales. You and we each agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim or dispute arising from, or related to, the Programme or these Terms & Conditions.

8.4 The Programme is operated by Hotspring Ventures Limited whose registered address is: Treatwell, Fairfax House, 15 Fulwood Pl, London WC1V 6HU.
